Judgment text excerpt

The Supreme Court upheld the High Court's decision affirming the dismissal of the appellant's suit for partition and separate possession under the Mysore (Religious and Charitable Inams) Abolition Act, 1955. The Court found that the respondent No.1 had been granted occupancy rights over the inam lands as the Archak of the temple, and that the appellant failed to prove that a partition had not been previously effected. The Court held that the appellant's claim for mesne profits was also untenable due to lack of evidence of joint possession.
