The Supreme Court held that the Division Bench of the Bombay High Court erred in dismissing the Letters Patent Appeal on the grounds of maintainability, referencing Rules 3 and 18 of the Bombay High Court Appellate Side Rules, 1960, and the Letters Patent of 1865. The Court established that applications under Article 226 or 227 should not deprive a party of the right to appeal under Clause 15 of the Letters Patent when substantial parts of the order pertain to Article 226. Consequently, the Supreme Court set aside the impugned order and directed that the Letters Patent Appeal be heard on merits.
