Judgment text excerpt

The Supreme Court ruled on the seniority dispute among Additional District and Sessions Judges appointed to the Delhi Higher Judicial Service under the Delhi Higher Judicial Service Rules, 1970. The Court held that the seniority of direct recruits must be determined in accordance with Rule 8(2), which mandates a rotation system between direct recruits and promotees. The Court quashed the Resolution dated 18.05.2007 of the Full Court of the High Court of Delhi, thereby upholding the petitioners' claim for seniority based on the prescribed rules.
