The Supreme Court held that non-communication of adverse entries in the Annual Confidential Report (ACR) of a public servant violates Article 14 of the Constitution, as it can adversely affect promotion opportunities. The Court emphasized that the appellant, who was not informed of a 'good' rating, should have been considered for promotion based on his previous 'very good' rating. Consequently, the Court allowed the appeal, ruling that the appellant's promotion should be granted in light of the CAT's directive and the arbitrary nature of the non-communication.
