Judgment text excerpt

The Supreme Court addressed the interpretation of a tripartite settlement regarding compassionate appointment under Paragraph 8.9.4, which stipulates that death must occur due to an accident arising out of and in the course of employment. The Court held that since the post-mortem report did not indicate an accidental death, the rejection of the appointment request was justified. The judgment of the Jharkhand High Court allowing the appeal was set aside, reaffirming that compassionate appointments are strictly governed by the terms of the settlement as per Section 12(3) of the Industrial Disputes Act, 1947.
