The Supreme Court held that the principles for condonation of delay and setting aside abatement in pending appeals, as established in Perumon Bhagvathy Devaswom Vs. Bhargavi Amma (Dead) by LRs & Ors. (2008) 8 SCC 321, and Ram Nath Sao @ Ram Nath Sahu & Ors. Vs. Gobardhan Sao & Ors. (2002) 3 SCC 195, necessitate allowing the applications for setting aside abatement and condoning delay. The Court set aside the High Court's orders dated 27.7.2005 and 13.12.2006, allowing the appellants to bring the legal representatives of the deceased third appellant on record and expediting the hearing of the restored appeal within six months.
