The Supreme Court held that if an inquiry is deemed nonest, the employee should be considered in service, and thus appropriate relief must be granted. The Court found that the High Court's direction to impose another punishment after setting aside the original order was contrary to law. The appeal was disposed of by modifying the High Court's order to grant family pension to the appellant from the date of her husband's death, without any monetary relief for the intervening period.
