GURRAM CHAKRAVARTHY vs STATE OF A.P.

The Supreme Court set aside the judgment of the Andhra Pradesh High Court which upheld the conviction of the appellant under Section 304B IPC for dowry death. The Court noted that the High Court failed to adequately discuss the evidence presented by the defense witnesses and did not properly consider whether the presumption under Section 113B of the Indian Evidence Act was rebutted. The matter was remitted back to the High Court for fresh consideration, with a request for expedited disposal within six months.
