The Supreme Court held that the principles for condonation of delay and setting aside abatement in pending appeals, as established in Perumon Bhagvathy Devaswom Vs. Bhargavi Amma (2008) and Ram Nath Sao Vs. Gobardhan Sao (2002), necessitate that the delay in bringing the legal representatives of a deceased appellant on record should be condoned. The Court set aside the High Court's orders dated 27.7.2005 and 13.12.2006, allowing the appellants to bring the LRs of the deceased third appellant on record and restoring the second appeal for expedited hearing. The appeal was thus allowed in favor of the appellants.
