The Supreme Court upheld the disqualification of the respondent for one academic session under Rule 9.2 of the Examination Rules of the National Council for Hotel Management and Catering Technology, following a finding of malpractice as defined in Rule 8.1. The Court clarified that possession of unauthorized material during an examination constitutes malpractice regardless of whether it was actually used, referencing C.B.S.E. vs. Vineeta Mahajan (1994) 1 SCC 6. The appeal against the Delhi High Court's dismissal of the Letter Patent Appeal was therefore dismissed, affirming the Institute's decision.
