The Supreme Court held that under Section 21(1)(b) of the Narcotic Drugs and Psychotropic Substances Act, the appellant, convicted for possession of 125 gms of heroin (less than the commercial quantity of 250 gms), had already undergone the substantive sentence of 10 years. The Court considered the circumstances of the case and reduced the default period of sentence to the time already served, allowing the appeal and ordering the appellant's immediate release.
