The Supreme Court held that under Rule 48(1)(a) of the Central Civil Services (Pension) Rules, 1972, the respondent's application for voluntary retirement was deemed effective as the three-month notice period expired on 31st August 2005, prior to the communication of the suspension order. The Court ruled that the order of suspension issued on 30th August 2005 was ineffective, as it was not communicated to the respondent until after the notice period had lapsed. Consequently, the Court upheld the Tribunal's decision that the respondent had effectively retired on 1st September 2005.
