Judgment text excerpt

The Supreme Court upheld the Labour Court's award granting overtime wages to the appellants under Section 33 C(2) of the Industrial Disputes Act, 1947, despite the respondent's claim that the appellants were managers and not workmen. The Court found that the appellants had indeed worked overtime, supported by documentary evidence, and that the management's behavior was reprehensible for not complying with the earlier award in favor of another employee. The High Court's dismissal of the management's writ petition was also affirmed, confirming the Labour Court's decision.
