The Supreme Court held that under Rule 48(1)(a) of the Central Civil Services (Pension) Rules, 1972, the respondent's request for voluntary retirement became effective on 1st September 2005, as the three-month notice period had expired and the order of suspension was not communicated until after this date. The Court ruled that the order of suspension dated 30th August 2005 was ineffective in law, as it was not communicated to the respondent until 2nd September 2005, thus upholding the Tribunal's decision. The appeal by the Union of India was dismissed, affirming the respondent's retirement status.
