Judgment text excerpt

The Supreme Court upheld the death sentence for Mohd. Afzal and Shaukat Hussain Guru under Section 302 read with Section 120B IPC and various provisions of the Prevention of Terrorism Act (POTA), including Sections 3(2), 3(3), and 4(b). The Court confirmed the High Court's decision to dismiss their appeals and affirmed the death sentence, while partly allowing Shaukat Hussain Guru's appeal by convicting him under Section 123 IPC with a 10-year rigorous imprisonment sentence. The Court acquitted S.A.R. Gilani and Navjot Sandhu alias Afsan Guru of all charges, leading to appeals by the State against their acquittal.
