The Supreme Court held that under Rule 48(1)(a) of the Central Civil Services (Pension) Rules, 1972, the respondent's application for voluntary retirement was deemed effective as the three-month notice period expired on 31st August 2005, prior to the communication of the suspension order. The Court emphasized that an order must be communicated to the affected individual to be binding, and since the suspension order was not communicated until 2nd September 2005, the respondent was entitled to retire from service effective 1st September 2005. The Court upheld the Tribunal's decision, ruling in favor of the respondent.
