Judgment text excerpt

The Supreme Court held that the availability of an alternative remedy is not an absolute bar to granting relief under Article 226 of the Constitution. The Court found that the High Court erred in dismissing the writ petition solely on the basis of alternative remedy when the respondent, Union of India, had admitted liability for a sum of Rs.3,56,69,671/- collected by mistake. The Court set aside the High Court's order, allowing the appeal and directing the respondents to pay the admitted liability with interest at 6% per annum within three months.
