Judgment text excerpt

The Supreme Court upheld the decision of the Punjab & Haryana High Court, affirming that the appellant, Som Lal, was disqualified from contesting the Sarpanch election under Section 208(1)(g) of the Punjab Panchayati Raj Act, 1994, due to his status as a whole-time salaried employee of the Haryana State Agricultural Marketing Board. The Court clarified that the provisions of Section 11 of the Punjab State Election Commission Act, 1994, do not exempt him from disqualification as he held an office of profit under a statutory body. Consequently, the appeal was dismissed, and the election of the appellant was set aside.
