The Supreme Court held that the disciplinary proceedings against Shri Ganesh Prasad Sharma were valid as they were initiated while he was still in service, specifically on 25.2.2003, prior to his retirement on 28.2.2003. The Court distinguished his case from that of Kaniya Lal, who had retired before any proceedings could be initiated. The Court set aside the orders of the Tribunal and the High Court, allowing the department to continue with the disciplinary proceedings against Sharma as per Rule 9(2)(a) & (b) of the CCS Pension Rules, 1964.
