Judgment text excerpt

The Supreme Court held that the appellant's act of stabbing the deceased, resulting in death, did not amount to murder under Section 302 IPC, as Exception 4 to Section 300 IPC was applicable due to the quarrel being over a petty issue and the infliction of a single stab injury. The Court modified the conviction from Section 302 IPC to Section 304 Part I IPC, sentencing the appellant to ten years of rigorous imprisonment while upholding the conviction under Section 341 IPC. The appeal was thus disposed of with the modified sentence.
