The Supreme Court held that the dependants of a missing government servant can be considered for compassionate appointment once the missing person is declared dead, as per the provisions of the relevant scheme. The Court found that the rejection of the second appellant's application for compassionate appointment was unjustified since Suresh Tiwary was declared dead only in 2002. The Court directed the State to reconsider the application in light of the established scheme for compassionate appointments.
