The Supreme Court held that the Calcutta High Court erred in dismissing the appellants' appeal in limine regarding the possession of premises originally owned by Mrs. Nasreen Wahhab. The Court found prima facie merit in the appellants' contention that M/s. Fortune Multitraders Ltd. was merely a table space holder and that the rights of other table space holders should not have been disregarded. Consequently, the Supreme Court set aside the High Court's judgment and remitted the matter for fresh consideration on merits.
