The Supreme Court held that the Central Bureau of Investigation (CBI) requires prior consent from the State Government under the Delhi Special Police Establishment Act, 1946 before initiating proceedings in a state where the alleged offence occurred, as per Article 166 of the Constitution. The Court found that the High Court erred in affirming the CBI's jurisdiction without such consent, leading to the conclusion that the proceedings against the appellant were without jurisdiction. Consequently, the appeal was allowed, and the proceedings initiated by the CBI were quashed.
