The Supreme Court held that the Insurance Company is not liable to pay compensation to a pillion rider as per the precedent set in New India Assurance Co. Ltd. Vs. Asha Rani & Ors., (2003) 2 SCC 223, which established that pillion riders are not covered under the insurance policy. Consequently, the Court set aside the High Court's order and allowed the appeal in favor of the Insurance Company.
