Judgment text excerpt
The Supreme Court, in Transfer Petition (Crl.) No. 21 of 2005, ordered the transfer of a complaint case alleging cheating from the Court of Judicial Magistrate, Betia, Bihar, to the Court of Chief Judicial Magistrate, Delhi. The petitioner, a permanent resident of New Delhi, contended that the case was filed falsely against him at the behest of the second respondent. The Court did not express any opinion on the merits of the case but allowed the transfer to ensure convenience and fairness in the proceedings.
