The Supreme Court held that the order of compulsory retirement under Clause (h) of Article 459 of the Civil Service Regulations does not constitute punishment and thus does not violate principles of natural justice. The Court found that the Review Committee had indeed considered the entire service record of the respondent, contrary to the High Court's findings. Consequently, the Supreme Court set aside the High Court's order nullifying the compulsory retirement, affirming the validity of the original order dated 16/5/1991.
