Citing Gian Dass vs. Gram Panchayat and C.A. Sulaiman & Ors. vs. State Bank of Travancore, the Court emphasized that without such formulation, the High Court's decision cannot stand. The Court set aside the High Court's judgment and remitted the matter for fresh consideration on merits within six months.
