The Supreme Court held that the High Court's judgment in Regular Second Appeal No. 3876 of 1997 was unsustainable as it failed to frame a substantial question of law as required under Section 100 CPC. Citing Gian Dass vs. Gram Panchayat and C.A. Sulaiman & Ors. vs. State Bank of Travancore, the Court emphasized that without such formulation, the High Court's decision cannot stand. The Court set aside the High Court's judgment and remitted the matter for fresh consideration on merits within six months.
