The Supreme Court held that the interpretation of Section 54 of the Forest Act by the High Court was incorrect, as it mandated the physical production of seized timber before the Magistrate prior to disposal. The Court clarified that while Section 61A allows for prosecution, disposal of timber can occur under the orders of the Magistrate without prior physical production. The Court set aside the High Court's order, allowing the Special Magistrate to proceed with the trial in accordance with law.
