Judgment text excerpt

The Supreme Court upheld the dismissal of the appellant-tenant's writ petition challenging the release application filed by the landlady under Section 21(1)(a) of the U.P. Urban Buildings (Regulation of Letting, Rent and Eviction) Act, 1972. The Court affirmed the findings of the lower courts regarding the bona fide need of the landlady for additional accommodation for her family, and the comparative hardship faced by her. The Court held that the tenant must vacate the premises within one year, contingent upon filing an undertaking with the Prescribed Authority.
