The Supreme Court ruled that under Section 17(iii)(b) of the U.P. Krishi Utpadan Mandi Adhiniyam, 1964, a market fee cannot be levied if agricultural produce is neither brought nor taken out of the market place. The Court held that the respondent, having purchased rice from outside U.P. for export, was not liable to pay the market fee demanded by the appellant. Consequently, the judgment of the Allahabad High Court was upheld, favoring the respondent.
