MALLEPUDI VENKATARAO vs STATE OF A.P.

The Supreme Court found that the High Court of Andhra Pradesh failed to consider the Commissioner’s report adequately in CRP No. 2706 of 1994, leading to an erroneous rejection of the report and exclusion of non-agricultural lands from consideration. The Court held that the High Court must reassess the case, giving proper weight to the Commissioner's findings and allowing the petitioner an opportunity to defend their case. Consequently, the Supreme Court set aside the High Court's order and remitted the matter for a fresh decision in accordance with law.
