Judgment text excerpt

The Supreme Court upheld the dismissal of writ petitions concerning the property Khasra No. 519, village Surjepur, Agra, which was declared evacuee property under the Administration of Evacuee Property Act, 1950. The Court affirmed that the property vested in the Custodian of Evacuee Properties after the migration of its owner, Abdul Wahid, to Pakistan in 1947-48. The Court ruled that the auction of the property under the Displaced Persons (Compensation & Rehabilitation) Act, 1955 was valid, and Harnath Chaturvedi's claims of hereditary tenancy were not substantiated, leading to the rejection of his appeal.
