Mohammed vs Pushpalatha

The Supreme Court held that under Section 51 of the Indian Contract Act, the appellant is liable to pay rent at the rate of Rs. 1250/- per month only after the construction of the toilet and possession is given. The Court affirmed the trial Court's decree for the construction of the toilet and directed that possession must be delivered within four months. If the toilet is not constructed, the High Court's judgment stands affirmed and the appeal is dismissed.
