The Supreme Court held that under Section 125 of the Code of Criminal Procedure, 1973, a wife is entitled to maintenance from her husband if she cannot maintain herself. The Court found that the wife's income of less than Rupees nine thousand per month was insufficient for her sustenance in Agra, while the husband's income was Rupees twenty thousand per month. Consequently, the Court directed the husband to pay maintenance of Rupees five thousand per month to the wife from the date of filing the petition, thereby allowing the appeal and setting aside the lower court's orders.
