The Supreme Court upheld the decision of the Jammu and Kashmir High Court regarding the proprietary rights of land allotted to displaced persons under Government Order No. 254 of 1965 and Cabinet Order No. 578-C of 1954. The Court clarified that upon the death of an allottee, the rights to the land devolve to family members as per Paragraph 15-B(2) of the Cabinet Order, which includes sons and daughters. The Court affirmed the High Court's ruling that the daughters of the deceased Makhan Singh were not entitled to a share in the property, as the succession was determined to be in favor of the sons only, thus dismissing the appeal.
