The Supreme Court held that the respondent, who was selected for the post of Mid-wife but not appointed, was entitled to appointment only from 1.11.1997, following the decree of 31.7.1997 which directed her appointment within three months. The Court clarified that there was no directive for retrospective appointment or benefits prior to the decree, thus the High Court's decision to grant benefits from 8.10.1991 was unsustainable. The appeal was allowed in part, modifying the effective date of appointment and salary accordingly.
