The Supreme Court addressed the issue of inter-se seniority between Maharashtra Public Service Commission (PSC) selectee employees and non-PSC employees, focusing on the validity of seniority lists published on March 6 and March 26, 1997. The Court held that the appointments of non-PSC employees made between 1962 and 1965 were not in accordance with the competitive examination process mandated by the amended Bombay Civil Services Classification and Recruitment Rules, 1939, under the proviso to Article 309 of the Constitution. Consequently, the Court ruled that the seniority lists were valid and upheld the rights of PSC selectees over non-PSC employees in terms of seniority.
