The Supreme Court addressed the issue of inter-se seniority between Maharashtra Public Service Commission (PSC) selectee employees and non-PSC selectee employees, focusing on the validity of seniority lists published on 6th and 26th March 1997. The Court held that the appointments of non-PSC employees were made without following the competitive examination process mandated by the Government of Maharashtra under the amended Bombay Civil Services Classification and Recruitment Rules, 1939, as per the provisions of Article 309 of the Constitution. Consequently, the Court ruled that the seniority lists were not in accordance with the law, thereby favoring the PSC selectees in the matter of seniority.
