Judgment text excerpt
The Supreme Court held that the High Court erred in directing the State of Maharashtra to condone the break in service of Respondent No.1 from 9.6.1986 to 10.6.1990, as it violated the Government Resolution dated 4th November, 1968 and Circular dated 10.5.1989, which stipulate that breaks exceeding two years cannot be condoned. The Court emphasized that the authority's discretion to condone breaks in service must adhere to these regulations. Consequently, the appeal was allowed, and the High Court's order was set aside.
