The Supreme Court held that the cancellation of permission granted to the appellant-Institution by the Secretary, Gujarat Secondary and Higher Secondary Education Board, was unjustified as the conditions for registration of the secondary school were fulfilled prior to the cancellation order dated 5th March, 2005. The Court emphasized that the authority's decision lacked merit and upheld the appellant's right to operate the school. Consequently, the appeal was allowed, and the cancellation order was set aside.
