The Supreme Court held that the conviction under Section 354 IPC for outraging the modesty of a woman was sustainable, while the charge under Section 3(1)(11) of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act was not, as the prosecutrix was not a member of a Scheduled Caste. The Court modified the sentence from six months rigorous imprisonment to the period already undergone, increasing the fine from Rs.300 to Rs.10,000, which must be paid to the prosecutrix. The appeal was disposed of accordingly.
