The Supreme Court addressed the issue of promotional opportunities for Diploma holders in the Madras Port Trust under the Major Port Trusts Act, 1963. The Court upheld the validity of the Madras Port Trust Employees (Appointment, Promotion, etc.) Regulations, 1977, particularly Regulation 5, which mandates a degree in Civil Engineering for the post of Executive Engineer. The Court ruled that the recommendations made by the Central Government for promoting Diploma holders should be considered, thereby affirming the need for a common seniority list for both Diploma and Degree holders, and allowing for retrospective promotions based on this principle.
