Judgment text excerpt

The Supreme Court held that the High Court's award of Rs.50,000 in compensation for a defective tubectomy operation was incorrect, as it relied on an overruled precedent from State of Haryana Vs. Santra (Smt.), (2000) 5 SCC 182. The Court noted that subsequent rulings in State of Punjab Vs. Shiv Ram & Ors., (2005) 7 SCC 1 and State of Haryana & Ors. Vs. Raj Rani, (2005) 7 SCC 22 had impliedly overruled the earlier decision. Consequently, the Supreme Court set aside the High Court's order and allowed the appeal.
