Judgment text excerpt

The Supreme Court held that workmen must establish their legal right to wages for working on Saturdays and Sundays under Section 33-C(2) of the Industrial Disputes Act, 1947. The Court affirmed that the appellants could raise all contentions before the Labour Court, and thus, it was unnecessary to interfere with the impugned judgment. The appeals were dismissed as the appellant, a 'State' under Article 12, did not dispute the legal rights of the respondents-workmen, and the High Court's directions to compute and pay the due amounts were upheld.
