The Supreme Court held that the qualifications for appointment as Assistant Master in Junior Basic Schools in U.P. are governed by Rule 8 of the U.P. Basic Education (Teachers) Service Rules, 1981, which requires both an Intermediate Certificate and a recognized training qualification. The Court found that the respondent, Upendra Rai, only possessed a Diploma in Education (D.Ed.), which was not recognized as equivalent to the required training qualifications after the U.P. Government Circular dated 11.8.1997 rescinded its prior equivalence. Consequently, the Court upheld the Division Bench's decision to set aside the earlier judgment and the Government Circular, affirming that the respondent was not eligible for appointment.
