The Supreme Court, in Civil Appeal No. 1283 of 2008, set aside the Madhya Pradesh High Court's order dated 15th February 2005, allowing the appellant to withdraw the petition and pursue a Letters Patent Appeal (LPA) under the Madhya Pradesh Uchcha Nayayalaya (Khand Nyaypeeth Ko Appeal) Adhiniyam, 2005. The Court held that the recent enactment provides the High Court with the authority to entertain LPAs against orders of a Single Judge, thus ensuring the appellant's right to seek remedy. The appeal was disposed of with directions for the High Court to hear the LPA in accordance with law.
