The Supreme Court held that under Section 4 of the Workmen's Compensation Act, 1923, the insurance contract remains enforceable despite the death of the insured, as the vehicle was still insured at the time of the accident. The Court clarified that the insurance policy, although renewed in the name of a deceased person, does not invalidate the claim for compensation. The appeal by the insurance company was dismissed, affirming the liability to pay compensation of Rs.1,42,465/- as determined by the Commissioner of Workmen's Compensation.
