M/S. Indian Metals & Ferro Alloys Ltd vs Jagdish Rai Puri & Ors

The Supreme Court set aside the Orissa High Court's judgment regarding the refusal of the State Government to grant permission for the transfer of government land, holding that the High Court should not have directed the State Government to grant permission or execute the deed. Instead, the Court remitted the matter back to the State Government for a fresh decision on the application for permission, in line with the principles established in Union of India & Another vs. Bilash Chand Jain & Another. The Court emphasized that the High Court cannot perform functions reserved for other authorities, thus allowing the appeals and dismissing the High Court's order to that extent.
