Judgment text excerpt
The Supreme Court held that the High Court erred in reversing the trial court's dismissal of a suit concerning the execution of a Will by Mst. Katra Wali, as the substantial question of law framed did not meet the criteria under Section 100 of the Code of Civil Procedure. The Court found that the evidence did not establish the presence of the testator during the signing of the Will. Consequently, the Supreme Court set aside the High Court's judgment and remitted the matter for fresh consideration, allowing the appeal without costs.
