The Supreme Court set aside the Full Bench decision of the Andhra Pradesh High Court in D. Gopaiah, which had declared the compassionate appointment scheme for dependants of government servants on medical invalidation unconstitutional. The Court held that the scheme, as per GOs dated 30.7.1980, 4.7.1985, and 9.6.1998, is valid. Consequently, the termination of the appellant's service on 1.9.2003 was declared invalid, leading to the reinstatement of the appellant with continuity of service but without back salary for the period not worked.
